Former President Donald Trump’s lawyers have defend his speeches and tweets leading up to the Jan. 6 Capitol riots as protected by his First Amendment right to free speech.
But the House managers prosecuting him are focusing on what Trump didn’t say as the riot escalated. They assert Trump’s muted response supports their case of inciting insurrection – the charge against the former president in his second impeachment trial.
“Our commander-in-chief who is known for sending 108 tweets in a normal day, sent five tweets and a pre-recorded video," said Rep. Joaquin Castro, D-Texas, said during Wednesday's hearing.
Castro and other House managers characterized Trump's reaction to the rioters as slow, ineffectual and implicitly in support the of rioters — similar to his response to other controversial events during his presidency.
